When using the website on behalf of a company or other organization, you represent that you have authority to act on behalf of that organization and to provide the information submitted.

4. Quote and Service Requests

Submitting a quote request, contact form, shipment inquiry, email, telephone message, or other communication does not create a binding transportation agreement.

All requests remain subject to review and acceptance by Truck Up Logistics. Service availability may depend on factors including:

  • Equipment and driver availability

  • Shipment size, weight, dimensions, and commodity

  • Pickup and delivery locations

  • Requested schedule

  • Operating authority and insurance requirements

  • Safety and regulatory considerations

  • Weather, traffic, road, or facility conditions

  • Customer credit or payment arrangements

  • Applicable laws and contractual requirements

A transportation service becomes confirmed only when Truck Up Logistics provides written acceptance or when the parties execute an applicable quote, rate confirmation, service agreement, work order, bill of lading, or similar transportation document.

Website estimates are preliminary unless expressly identified as final and binding.

5. Transportation Service Agreements

These Terms govern use of the website. They do not replace the specific terms applicable to an accepted shipment or transportation service.

Confirmed services may be governed by additional documents, including:

  • Written quotations

  • Rate confirmations

  • Transportation service agreements

  • Bills of lading

  • Customer contracts

  • Carrier or broker agreements

  • Credit applications

  • Accessorial schedules

  • Cargo-handling instructions

If these Website Terms conflict with a separately executed written service agreement, the separately executed agreement will control with respect to the applicable transportation service.

6. Shipment Information

You are responsible for providing complete and accurate shipment information, including:

  • Commodity description

  • Number of pieces or pallets

  • Weight and dimensions

  • Pickup and delivery addresses

  • Facility hours and appointment requirements

  • Required equipment

  • Loading and unloading requirements

  • Special handling instructions

  • Known hazards, restrictions, or permit requirements

Truck Up Logistics may revise or withdraw a quote if the information provided is inaccurate, incomplete, or materially changes.

Additional charges may apply for services such as waiting time, detention, redelivery, additional stops, inside delivery, liftgate service, driver assistance, storage, appointment changes, excessive loading or unloading time, after-hours service, tolls, permits, or other services outside the original scope.

7. Restricted and Prohibited Shipments

You may not request transportation of illegal, stolen, counterfeit, hazardous, dangerous, restricted, or prohibited goods without prior written disclosure and approval.

Restricted items may include hazardous materials, firearms, ammunition, explosives, controlled substances, alcohol, tobacco products, live animals, human remains, high-value items, temperature-sensitive products, medical specimens, cash, negotiable instruments, or other regulated commodities.

Truck Up Logistics reserves the right to reject any shipment that presents an unacceptable legal, regulatory, safety, insurance, operational, or reputational risk.

8. No Guaranteed Availability or Delivery Time

Truck Up Logistics strives to provide reliable and timely service. However, website information, estimated arrival times, equipment availability, route schedules, transit times, and delivery windows are not guaranteed unless expressly confirmed in a written agreement.

Transportation may be affected by circumstances outside our reasonable control, including traffic, road closures, weather, mechanical issues, facility delays, shipper or consignee delays, government actions, emergencies, labor disruptions, natural disasters, or other unforeseen events.

Do not rely on an unconfirmed website inquiry for emergency, critical, medical, time-sensitive, or consequential shipments.

9. Customer Responsibilities

When requesting or purchasing services, you are responsible for:

  • Providing accurate information

  • Properly packaging, labeling, and preparing freight

  • Disclosing special handling requirements

  • Providing safe and reasonable facility access

  • Obtaining required permits or approvals unless otherwise agreed

  • Ensuring authorized personnel are available at pickup and delivery

  • Paying agreed charges and applicable accessorial fees

  • Complying with applicable laws and safety requirements

Truck Up Logistics may decline service when freight is improperly packaged, unsafe to handle, inaccurately described, overweight, inaccessible, prohibited, or outside the agreed service scope.

10. Payments and Charges

Payment terms, accepted payment methods, deposits, credit arrangements, cancellation charges, accessorial fees, and late-payment requirements will be stated in the applicable quote, invoice, credit agreement, rate confirmation, or service agreement.

Unless otherwise agreed in writing, customers are responsible for all authorized transportation charges and additional costs incurred in completing or attempting the requested service.

18. Limitation of Liability

To the fullest extent permitted by applicable law, Truck Up Logistics and its owners, officers, employees, contractors, representatives, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from website use, inability to access the website, reliance on website content, or an unconfirmed service inquiry.

This limitation does not replace or alter any liability provision contained in an applicable transportation contract, bill of lading, rate confirmation, insurance policy, or separately executed service agreement.

Nothing in these Terms excludes liability that cannot legally be limited or excluded.

19. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Truck Up Logistics and its owners, officers, employees, contractors, and representatives from claims, losses, liabilities, damages, and reasonable expenses arising from:

  • Your unlawful or unauthorized website use

  • Information you submit

  • Your violation of these Terms

  • Your infringement of another person’s rights

  • Fraudulent or materially inaccurate shipment information

This section does not apply to claims caused solely by the gross negligence or intentional misconduct of Truck Up Logistics.

20. Privacy

Your use of the website is also subject to the Truck Up Logistics Privacy Policy.

The Privacy Policy explains how we may collect, use, retain, protect, and disclose information submitted through the website and related communications.

21. Governing Law and Venue

These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law principles.

To the extent a dispute is not governed by a separate written transportation agreement and may lawfully be brought in court, the parties agree that the appropriate state or federal courts located in Clark County, Nevada, will have jurisdiction.

22. Changes to These Terms

Truck Up Logistics may update these Terms to reflect changes in the website, services, business practices, or legal requirements.

The revised Terms will be posted with a new effective date. Changes will apply prospectively from the posted effective date unless applicable law requires otherwise.

Your continued use of the website after updated Terms become effective constitutes acceptance of the revised Terms.

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will continue in effect.

An unenforceable provision will be interpreted or limited to the minimum extent necessary to make it enforceable where permitted by law.
